Terms of Service
Version 2026.04.10 · Effective April 10, 2026
1. Services
DFW Site Metrics LLC ("we," "us") provides drone aerial photography, videography, orthomosaic imagery, terrain data, and related mapping deliverables ("Deliverables"), plus hosted delivery of those Deliverables through this platform. Engagements are per-job under a written scope; flights are conducted under FAA Part 107 by an insured, certificated remote pilot.
2. What our deliverables are — and are not
All Deliverables are aerial imagery and photogrammetric data provided for informational, planning, and estimating purposes only. They are not a survey. They do not depict or determine property boundaries. DFW Site Metrics LLC is not a registered professional land surveying firm and does not offer professional surveying services. Boundary, title, platting, or metes-and-bounds needs require a Texas Registered Professional Land Surveyor.
Where parcel lines appear in a Deliverable, they are the unmodified GIS parcel layer of the applicable county appraisal district, reproduced for general reference only. Such data is not survey grade and must not be used for legal purposes. Acreage figures are quoted from public records and attributed to their source, never measured by us.
3. Client obligations
- Written consent of the landowner or occupant for image capture (Tex. Gov't Code §423.002(a)(6)) before the flight, which we record with the job.
- Safe, lawful site access for the flight window, and disclosure of any known hazards or restrictions.
- Timely review and acceptance of Deliverables.
4. Payment
Work is invoiced per the written scope for each job. Invoices are due on delivery unless the scope states otherwise. We do not currently offer subscriptions.
5. License and ownership
On payment in full, the client receives a perpetual, non-exclusive license to use the Deliverables for the purposes stated in the scope (e.g., listing marketing, project documentation). We retain ownership of raw captures and processing intermediates, and — only where a recorded consent permits — the right to display selected Deliverables in our portfolio.
6. Accuracy
Where a scope includes accuracy documentation, we report measured values (checkpoint residuals, RMSE, ground sample distance, coordinate reference system, and vertical datum). We make no accuracy claims beyond those measured values, and Deliverables must not be used for construction staking, boundary location, or other licensed work.
7. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of a job is limited to the amount paid for that job. We are not liable for indirect, incidental, or consequential damages, or for decisions made in reliance on Deliverables outside their stated purpose.
8. Weather and airspace
Flights are subject to weather, airspace authorization, and regulatory constraints. If a scheduled flight cannot be conducted safely or lawfully, it will be rescheduled without penalty.
9. Governing law
These terms are governed by the laws of the State of Texas. Questions: info@dfwsitemetrics.com.
